Kamm/Blau/Haaretz are Full of Misinformation

If I find an English version, I'll link but in the meantime, this Globes report below informs us that Israel's Ministry of Justice has republished a letter to the two lawyers who insisted that the IDF policy of targeted executions was illegal (and therefore allowing Kamm to presume they were war crimes and which allowed Blau to publish his profile which the military censor permitted) which makes it clear that no criminal act was done, no 'war crime' was committed and no infraction, violation or other illegal act was done in following the orders.

אלוף פיקוד המרכז לשעבר, יאיר נוה, וצה"ל לא הפרו את הנחיות בג"ץ בנוגע לחיסולים, כפי שנטען בכתבתו של העיתונאי אורי בלאו מנובמבר 2008, שהתבססה על מסמכים שהודלפו על-ידי ענת קם, המואשמת בריגול חמור - כך טוען משרד המשפטים בהודעה שפירסם היום (ב') בצהריים.

המשרד החליט לפרסם מחדש מכתב שהוציאה לשכת היועץ המשפטי לממשלה כבר בינואר 2009, בתשובה לדרישתם של עו"ד אביגדור פלדמן ומיכאל ספרד לפתוח בחקירה פלילית כדי לבדוק אם נעברו עבירות פליליות על-ידי צה"ל או מי מקציניו.

בעקבות פנייתם של פלדמן וספרד, פנתה לשכת היועץ המשפטי לפרקליט הצבאי הראשי, תת-אלוף אביחי מנדלבליט, וקיבלה תשובות מספקות בנוגע ל-3 האירועים המתוארים בכתבה, שבמסגרתם חוסלו מבוקשים.

באשר לפעולה בג'נין ביולי 2006 קבע היועץ המשפטי דאז, מני מזוז, כי "בתכנון המבצע הודגש על-ידי השב"כ כי המבצע המוצע הוא בראש ובראשונה מבצע למעצרם של המבוקשים. עם זאת, במהלך התכנון התברר כי בהיעדר יכולת מעצר, יש אישור לפגוע במבוקשים בהתאם לנוהל. פעולת צה"ל עמדה באירוע זה בכל הכללים שהותוו בפסיקת בג"ץ ביחס ל'סיכול ממוקד'".

אשר לפעולה בשכם בדצמבר 2006, מדובר היה במבצע למעצרו של בכיר בתנזים, ולא במבצע שנועד מלכתחילה לפגוע בו. אלא ש"לעתים מסתיימים מבצעי מעצר במותו של מבוקש, ואין בכך כדי לגרוע מן העובדה שמדובר היה במבצע מעצר לכל דבר ועניין".

לגבי הפעולה בכפר אל-יאמון בנובמבר 2006, "במהלך פעילות כוחות צה"ל בכפר אירעה היתקלות בין הכוחות לבין כ-10 מחבלים חמושים, ובמקום התפתחו חילופי אש. כתוצאה מן הירי נהרגו 5 מחבלים חמושים, ושלושה נעצרו". לפיכך, טוען משרד המשפטים, "אין כל יסוד לטענה לפיה צה"ל התעלם מהוראות בג"ץ בנוגע לפעולות 'סיכול ממוקד'".‏

On Monday, the Justice Ministry spokesman released a letter by former Attorney-General Menahem Mazuz. It was written 15 months ago in response to a demand by attorneys Avigdor Feldman and Michael Sfard to investigate allegations in the article that the IDF was continuing to carry out targeted assassinations in violation of conditions set down in a High Court of Justice ruling. Three cases were referred to, including the killing of key Islamic Jihad terrorist Ziad Malaisha...

Blau charged that the description of the mission as an arrest operation was just a cover-up for the real intent, which was to assassinate Malaisha and the others.

He also wrote that he showed the document to experts in international and criminal law including Hebrew University Prof. Mordechai Kremnitzer and retired Hebrew University Prof. David Kretzmer, and both said the operation was in clear violation of the High Court ruling.

The Justice Ministry spokesman’s office said Monday that several reporters had asked whether Mazuz had ordered an investigation into the allegations raised in the article after it was published.

...Mazuz wrote back on January 7, 2009...Regarding the killing of Malaisha, Mazuz wrote, “The IDF operation met all the conditions laid down in the Bagatz ruling regarding ‘targeted assassinations.’ The attack took place after the possibility of arresting the fugitives was ruled out as being impossible to achieve under the circumstances and after it was made clear to the soldiers that arrest was the first preference.

“The attack was aimed at senior and extremely dangerous terrorists, who were involved in preparations to carry out dangerous terror attacks, and regarding whom the security system had reliable and precise information ... It was carried out in awareness of the duty to avoid harming innocents and reduce the danger to them, and after implementing the principle of proportionality.”

Mazuz added that “the legal aspects of the operation were examined at each one of the planning stages and there is no basis to the charge that the IDF ‘ignored’ the High Court’s instructions regarding targeted assassination operations. On the contrary, the operational officers in the general staff, who had close legal consultation, were aware of the High Court instructions and stressed and carried them out in all stages of the planning and the approval of the operation.”
