Here's the "justification":-
Samir Kuntar was a 16-year-old when he was imprisoned in Israel for killing a police officer, a civilian and a child.
I don't agree with that semantic portrayal.
Kuntar was not a soldier who was involved in a prisoner exchange but a terrorist who invaded another country to kill. He killed, was arrested, judged and sentenced according to the law. He was released because Hezbollah had kidnapped soldiers. That's a big difference but you wouldn't know that from the NYTimes reporting.
