Justice for the Judge?

On Jul 1, I blogged about an outrageous case of British injustice involving a judge, brought out of retirement, to oversee a trial involving the claim that because Israel supposedly committed "war crimes", demonstrators with impunity could cause 180,000 pounds sterling worth of damage.

I found out he was actually born in Mandate Palestine and that element is still being investigated if it had any influence on his obscene views although his father seems not to have been actually a Mandate official. Melanie Phillips hat-tipped me.

Jonathan Hoffman has been on this in a parallel effort to work for true justice.

A senior judge was under investigation yesterday after being accused of making anti-Semitic remarks in court that may have swayed his jury into acquitting a group of protesters.

Judge George Bathurst-Norman was said by critics to have persuaded a jury to clear a group of campaigners who smashed up a factory making parts for Israeli warplanes.

Summing up in the criminal damage trial, he compared Israel to the Nazi regime and accused the country of ignoring international law.

The judge added that 'there may be much to be admired' about the chief protester, and that 'in the last war he would probably have received a George Medal'.

The Office for Judicial Complaints, which deals with objections over the conduct of judges and magistrates, confirmed that an inquiry into how Judge Bathurst-Norman handled the trial of five political activists at Hove Crown Court in June is under way.

Its findings will be considered by Lord Chief Justice Lord Judge and Lord Chancellor Kenneth Clarke, who have the final say on any disciplinary action.

A number of complaints are said to have accused the judge not just of anti-Israel rhetoric but specifically of anti-Semitism.

...Describing evidence shown in court, Judge Bathurst-Norman told the jury that he could only describe the 'horrific' events shown as 'scenes which one would rather have hoped to have disappeared with the Nazi regimes of the last war'.

In his summing up, he gave his backing to the evidence of one defendant, Ornella Saibene, a former Greenham Common activist.

The judge said: 'She took us through the horrors, and there really is no other word for it than horrors, that emerged in the press and on the news and the footage as to what the Israelis were doing in Gaza.

'You may think that perhaps "Hell on Earth" would be an understatement of what the Gazans endured.'

...Jonathan Hoffman, of the Zionist Federation, said: 'This opens the door to any group which thinks the British presence in Afghanistan is wrong to go and smash up plants supplying British forces.'

Will true justice win out?

Hell on Earth - An English Courtroom

Five activists who caused £180,000 damage to an arms factory were acquitted after they argued they were seeking to prevent Israeli war crimes.

The five were jubilant after a jury found them not guilty of conspiring to cause
criminal damage to the factory on the outskirts of Brighton. The five admitted they had broken in and sabotaged the factory, but argued they were legally justified in doing so.

They believed that EDO MBM, the firm that owns the factory, was breaking export regulations by manufacturing and selling to the Israelis military equipment which would be used in the occupied territories. They wanted to slow down the manufacture of these components, and impede what they believed were war crimes being committed by Israel against the Palestinians. ...They are the latest group of peace and climate-change activists to successfully use the "lawful excuse" defence – committing an offence to prevent a more serious crime – as a tactic in their campaigns...They had decided to act last January after three weeks of Israeli military manoeuvres against Gaza in which many Palestinians were killed. According to a UN investigation by former South African judge Richard Goldstone, Israel committed war crimes by deliberately attacking civilians during the offensive known as Operation Cast Lead.

In his summing up, Judge George Bathurst-Norman suggested to the jury that "you may well think that hell on earth would not be an understatement of what the Gazans suffered in that time".

The judge highlighted the testimony by Caroline Lucas, the Green MP for Brighton Pavilion, that "all democratic paths had been exhausted" before the activists embarked on their action.

Hove crown court heard the activists had broken into the factory in the night. They had video-taped interviews beforehand outlining their intention to cause damage and, in the words of prosecutor Stephen Shay, "smash-up" the factory.


Actually, I think Judge Bathurst-Norman's courtroom is a bit of hell on earth.

The witnessess lied in his courtroom and he bolstered their mendacity.

Oddly enough, he has been quoted as warning:

that Britain risks falling into anarchy or becoming a police state if confidence in the judiciary is lost. He said that political decisions...had tied judges' hands and led to "silly" sentences.

..."The trouble is, if you go on for political reasons undermining the public's faith in the judiciary, sooner or later you are heading for anarchy and... in due course for the equivalent of a police state."



I wonder, is the judge a "Palestinian"?

And Judge George Bathurst-Norman, who has previously had a record as quite a law’n’order judge, gave a summing up so favourable that some supporters were worried that the jury might react to what they perceived as an attempt to bounce them into a not guilty verdict. We need not have worried! Perhaps the fact that His Honour was born in the Arab town of Jaffa opposite Tel Aviv might have something to do with it! Judge George Bathurst-Norman was brought out of retirement to hear the case.

Should the Punishment Fit the Crime?

Let me make this clear from the outset - I do not support a Saudi Arabian/Sha'ariya system of justice but nevertheless, I am always interested in a) testing the limits of logic and b) being a bit impish, so, now you can read on:-

Florida has come up with an interesting idea -

Rapist agrees to castration punishment for sexual battery

PANAMA CITY, Fla. - A confessed rapist has agreed to be castrated in a plea deal that could save him from a life prison sentence.

Bobby James Allen pleaded guilty Monday to three counts of armed sexual battery and various other charges involving attacks that happened in 1998 and 1999. Allen filed a motion requesting castration in exchange for a reduced sentence.


Does that mean that arms can be dismembered for throwing stones and firebombs?

That fingers can be amputated for pulling triggers?

This could be a unique way to stop terror.

Klug is Sluggish

Brian Klug, senior research fellow in philosophy at St Benet's Hall, Oxford, and associate editor of Patterns of Prejudice, has a problem. And being a good Jew, he takes that problem to The Guardian where he published an op-ed entitled, "No one has the right to speak for British Jews on Israel and Zionism".

He announced there that "We will not accept the vilification of those who protest at injustices carried out in the name of the Jewish people". Notice the "we"? The Royal "we", or the Papal "we".

And he goes on:-

today an oppressive and unhealthy atmosphere is leading many Jews to feel uncertain about speaking out on Israel and Zionism. People are anxious about contravening an unwritten law on what you can and cannot discuss, may or may not assert. It is a climate that raises fundamental questions: about freedom of expression, Jewish identity, representation...Anguish turns to outrage when the human rights of a population under occupation are repeatedly violated in the name of the Jewish people.

No one has the authority to speak for the Jewish people...

...Faced with this state of affairs, a group of Jews in Britain has come together to launch Independent Jewish Voices (IJV). We come from a variety of backgrounds and walks of life. we are united by certain fundamental commitments...They include: putting human rights first; giving equal priority to Palestinians and Israelis in their quest for a peaceful and secure future; and repudiating all forms of racism aimed at Jews, Arabs, Muslims or whomever.

We believe that these commitments - not ethnic or group loyalties - define the limits of legitimate debate. We invite like-minded Jews in Britain to add their names to the list of IJV signatories...

...when we speak out against Israel's occupation of the West Bank and Gaza, or the bombing of Lebanon, or discrimination against Palestinians within Israel itself, we are not turning against our Jewish identity; we are turning to it. Some of us, recalling that nearly 40 years have passed since Israel's occupation began, hear a resonance. This was the length of time the Israelites wandered in the wilderness, near the end of which Moses gave them a directive: "Justice, justice shall you pursue" (Deuteronomy 16:20). It is a compass bearing for all humanity, especially when we are trying to find our way - or help others to find theirs - to a better future.


So, here's my letter-to-the-editor:-

Brian Klug bemoans an "oppressive atmosphere" that limits, he asserts, his and his comrades' freedom of expression within the Jewish community in the UK ("No one has the right to speak for British Jews on Israel and Zionism", Feb. 5). Well, thank God for The Guardian then.

As Klug is well aware, it is not the principle that is in dispute but the details. When critics of Israel's policies in the disputed territories or in Lebanon or in Israel itself adopt a standard of moral inequivalency, ignore Arab sins, glide over major societal and cultural differences, fudge historical facts, forget legal rights and in general, act in a street gang manner, they should know that it is fair and just to question their Jewish identity, or, at the very least, cast doubt whether they are interpreting to the non-Jewish public what Jewish identity is and what is Jewish nationalism.

The Biblical verse he quotes from Deuteronomy, "Justice, justice shall you pursue", is interpreted by the Rabbis as meaning that justice shall be pursued with justice. Klug , in his injudicious claims, is violating that instruction.
